your argument is correct of California law, but it is also factually correct that same sex couples are unable to recieve benefits like medicaid because those are regulated by federal law. This is entirely external to the question of Prop 8, but I just wanted to clarify. This is in The Defense of Marriage Act, Section 3 I believe.
